Terms of Service

1. Introduction and Acceptance

Welcome to Selfbit ("we," "our," "us," or the "Platform"). Selfbit is an AI-powered behavioral operating system designed to help you build better habits through intelligent tracking, health data correlation, and personalized insights.

By accessing or using the Selfbit mobile application, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

These Terms, together with our Privacy Policy and Health Data Privacy Notice, govern your use of Selfbit.

2. Eligibility

To use our Services, you must:

  • Be at least 13 years old (or 16 in the EU)
  • If under 18, have parental or guardian consent
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Services under applicable law
  • Provide accurate and complete registration information

Health Data Notice

If you are under 18, certain health-related features may be restricted or require additional parental consent as required by COPPA, GDPR-K, and healthcare privacy regulations.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your login credentials confidential and secure
  • Notify us immediately of any unauthorized access to your account
  • Not share your account with others or allow others to access your account

3.2 Account Security

You are solely responsible for:

  • All activities that occur under your account
  • Maintaining the security of your account credentials
  • Any consequences of unauthorized access due to your failure to safeguard your credentials
  • Enabling additional security features (biometric authentication, 2FA) when available

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent, abusive, or illegal activity
  • You misuse AI features or attempt to circumvent usage limits
  • Your account remains inactive for an extended period (24+ months)
  • Required by law or to protect the Platform's integrity

4. Service Description

4.1 Core Features

Selfbit provides:

  • Habit Tracking: Create, track, and manage personal habits and goals
  • Journaling: Record thoughts, reflections, and progress notes
  • Health Integration: Connect with Apple HealthKit for health-habit correlation
  • Calendar Integration: Connect with Google Calendar for context-aware insights
  • AI-Powered Insights: Personalized recommendations and behavioral analysis
  • Progress Analytics: Visualizations, streaks, and performance trends

4.2 AI Features

Selfbit's AI capabilities include:

  • Progressive AI Intelligence: 4-level enrichment system based on connected data sources
  • Habit-Health Correlation: Analysis of relationships between health metrics and habit success
  • Smart Recommendations: Personalized timing and intensity suggestions
  • Daily Summaries: AI-generated insights and action items
  • Proactive Adjustments: Automatic habit difficulty adjustments based on your state

4.3 Multi-Provider AI (BYOT - Bring Your Own Token)

Selfbit supports multiple AI providers:

  • Supported Providers: Claude AI (Anthropic), OpenAI (GPT), Google Gemini
  • Your API Keys: You may optionally provide your own API keys for enhanced AI features
  • Key Security: API keys are encrypted and stored securely; we never access your keys for any purpose other than making AI requests on your behalf
  • Usage Responsibility: When using your own API keys, you are responsible for associated costs and compliance with the AI provider's terms

Important

When you provide your own API keys, requests are made directly to those providers. You are bound by their respective terms of service and privacy policies in addition to ours.

5. Subscription and Payments

5.1 Service Model

The Selfbit mobile application is a client that connects to the Selfbit service. Account creation and subscription management occur on our website at apps.mitikasha.com/selfbit. No purchases occur within the mobile application.

5.2 Subscription Tiers

Selfbit offers the following subscription options, managed through our website:

  • Free BYOT Tier: Basic habit tracking, bring your own AI API keys
  • Premium Tier ($9.99/mo): 25,000 AI tokens/month, full features, environmental context
  • Pro Tier ($24.99/mo): 60,000 AI tokens/month, family sharing, advanced analytics

5.3 Payment Processing

All payments are processed by Lemon Squeezy, our Merchant of Record. Lemon Squeezy handles billing, tax compliance (VAT, GST, sales tax), and payment processing on our behalf. By subscribing, you also agree to Lemon Squeezy's terms of service.

  • Subscriptions are managed at apps.mitikasha.com/selfbit/account
  • Billing occurs at the start of each subscription period (monthly or annually)
  • Prices are subject to change with 30 days notice
  • We do not store payment card details; all payment data is handled by Lemon Squeezy
  • Taxes are calculated and collected automatically by Lemon Squeezy based on your location

5.4 Feature-Based Cost Control

Selfbit uses a transparent token-based system:

  • Token Allocation: Premium users receive 25,000 tokens/month, Pro users receive 60,000 tokens/month
  • Usage Visibility: You can see AI token usage in real-time within the app
  • BYOT Option: Free tier users can use their own AI API keys for unlimited usage
  • No Surprises: We will notify you when you approach your token limit

5.5 Cancellation and Refunds

  • Cancellation: You may cancel your subscription at any time through your account page at apps.mitikasha.com/selfbit/account
  • Access After Cancellation: You retain access to premium features until the end of your current billing period
  • Refunds: Refund requests are subject to our refund policy; contact support@mitikasha.com
  • Data Retention: Your data is retained for 30 days after subscription ends, then deleted unless you resubscribe

6. Health Data Terms

Medical Disclaimer

Selfbit is NOT a medical device, healthcare provider, or substitute for professional medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical decisions.

6.1 Health Data Usage

When you connect Apple HealthKit:

  • Health data is used solely for habit correlation and personalized insights
  • We comply with Apple's HealthKit guidelines and HIPAA standards
  • Health data is never sold, shared with advertisers, or used for marketing
  • You maintain full control over which health data types to share

6.2 Limitations

  • AI insights are informational only, not medical advice
  • Health correlations are statistical patterns, not causal relationships
  • Do not use Selfbit to diagnose, treat, or prevent any medical condition
  • Exercise recommendations should be validated by healthcare professionals
  • If you experience health concerns, consult a doctor immediately

7. User Content and Data

7.1 Your Content

You retain ownership of all content you create in Selfbit, including:

  • Habit definitions and descriptions
  • Journal entries and notes
  • Goals and personal objectives
  • Custom categories and tags
  • Profile information and preferences

7.2 License Grant

By using Selfbit, you grant us a limited license to:

  • Store and process your content to provide the Services
  • Use your content to generate AI insights and recommendations
  • Create anonymized, aggregated statistics for service improvement
  • Back up your content for data protection purposes

This license terminates when you delete your account.

7.3 Data Portability

You have the right to export your data at any time in standard formats (JSON, CSV). Use Settings > Privacy & Data Management > Export Data.

8. AI Terms and Limitations

8.1 AI-Generated Content

AI features in Selfbit are subject to these terms:

  • Not Guaranteed: AI outputs are generated algorithmically and may contain errors
  • Review Required: You should review AI suggestions before acting on them
  • No Professional Advice: AI insights do not constitute professional advice of any kind
  • Continuous Improvement: AI models and outputs may change over time

8.2 Fair Usage

To ensure service quality for all users:

  • AI features are subject to reasonable usage limits
  • Automated or scripted access to AI features is prohibited
  • Excessive usage that impacts service quality may result in temporary restrictions
  • BYOT users with their own API keys have higher or no limits

8.3 Third-Party AI Providers

When using AI features:

  • Your data may be processed by third-party AI providers (Anthropic, OpenAI, Google)
  • We select providers with strong privacy and security practices
  • Data sent to AI providers is minimized and anonymized where possible
  • You can opt out of AI features entirely and use Selfbit as a traditional habit tracker

9. Prohibited Conduct

You agree not to:

9.1 General Prohibitions

  • Use the Services for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Interfere with the proper functioning of the Services
  • Impersonate any person or entity

9.2 Technical Prohibitions

  • Reverse engineer, decompile, or disassemble the Services
  • Use automated systems, bots, or scrapers without permission
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to systems or data
  • Circumvent security measures or usage limits
  • Exploit bugs or vulnerabilities (please report them to security@mitikasha.com)

9.3 AI-Specific Prohibitions

  • Attempt to extract or reverse-engineer AI model weights or training data
  • Use AI features to generate harmful, illegal, or deceptive content
  • Deliberately input false data to manipulate AI outputs
  • Resell or redistribute AI-generated content commercially
  • Use AI features in ways that violate third-party AI provider terms

10. Intellectual Property

10.1 Our Intellectual Property

Selfbit and its licensors own all rights, title, and interest in:

  • The Selfbit name, logo, and trademarks
  • The app's design, features, and user interface
  • All software, code, and technical implementations
  • AI models, algorithms, and analytical methods
  • All content created by Selfbit (excluding user content)

10.2 Feedback

If you provide feedback, suggestions, or ideas, you grant us a non-exclusive, perpetual, irrevocable license to use, modify, and incorporate such feedback into our Services without compensation.

11. Disclaimers

11.1 Service Availability

The Services are provided "AS IS" and "AS AVAILABLE." We do not guarantee:

  • Uninterrupted or error-free operation
  • That defects will be corrected immediately
  • That the Services will meet your specific requirements
  • The accuracy, reliability, or completeness of AI-generated content
  • Specific results from using the Services

11.2 No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.3 Third-Party Services

We are not responsible for third-party services (Apple HealthKit, Google Calendar, AI providers) and their availability, accuracy, or terms.

12. Limitation of Liability

12.1 Exclusion of Damages

To the maximum extent permitted by law, Selfbit shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from AI recommendations or insights
  • Health-related decisions made based on Selfbit data or AI suggestions
  • Damages resulting from unauthorized access to your account
  • Service interruptions or data loss

12.2 Cap on Liability

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the greater of: (a) the amount you paid to Selfbit in the 12 months preceding the claim, or (b) $100 USD.

12.3 Essential Purpose

These limitations apply even if any remedy fails of its essential purpose and regardless of whether we were advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless Selfbit, Mitikasha, and their officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your content or data submitted to the Platform
  • Your use of AI features or AI-generated content
  • Any misuse of your provided API keys

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, you agree to contact us at legal@mitikasha.com to attempt informal resolution. We will work in good faith to resolve disputes within 30 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

15. Changes to Terms

We may modify these Terms at any time. When we do:

  • We will update the "Last Updated" date at the top
  • We will notify you of material changes via email or in-app notification at least 30 days in advance
  • Continued use of the Services after changes constitutes acceptance
  • If you disagree with changes, you must stop using the Services

16. Termination

16.1 By You

You may terminate your account at any time by:

  • Using the account deletion feature in Settings > Privacy & Data Management
  • Contacting us at support@mitikasha.com

16.2 By Us

We may terminate or suspend your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Required by law
  • We discontinue the Services (with reasonable notice)

16.3 Effect of Termination

Upon termination:

  • Your right to use the Services ceases immediately
  • We will delete your personal data within 30 days (except as required by law)
  • You may export your data before termination
  • Provisions that should survive termination (liability, disputes) remain in effect

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and Health Data Privacy Notice, constitute the entire agreement between you and Selfbit.

17.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.

17.3 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

17.4 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

17.5 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control.

19. Region-Specific Provisions

19.1 European Union Users

If you are in the EU, you have additional rights under GDPR as described in our Privacy Policy. Nothing in these Terms limits your statutory rights under EU consumer protection laws.

19.2 California Users

If you are a California resident, you have additional rights under CCPA/CPRA as described in our Privacy Policy.

19.3 Australia Users

If you are in Australia, nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law.

By using Selfbit, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
